The Modi government is preparing to introduce a bill in parliament to amend the Waqf Act, aiming to limit the powers of the Waqf Board. The proposed bill, expected to be presented soon, includes around 40 amendments that seek to restructure the composition of the Central Waqf Council and state Waqf boards. This move comes as a significant step towards addressing issues related to land encroachment and misuse of powers granted under the current legislation.
The bill proposes to amend Section 9 and Section 14 of the Wakf Act to change the composition of Central Waqf Council and state Waqf boards, to ensure representation for women in the bodies. The bill also proposes to seek fresh verification of the disputed land claimed by the state Waqf boards. This is seen as a way to curb the “unfettered” powers of Waqf Boards to declare any property a ‘waqf asset’ and take control of it.
The need for such legislation arose as there were several representations from Muslim intellectuals, women and different sects such as Shia and Bohras, among others, seeking changes in the existing law. The timing of bringing the bill assumes significance as the assembly polls in three states — Haryana, Maharashtra and Jharkhand are likely to be held in October this year.
The bill, approved by the Union Cabinet, aims to address issues like disputed land claims and representation for women in Waqf bodies. It is expected to be tabled in the parliament soon, marking a major step towards reforming the functioning of the Waqf Board.
